"一国两制" is not two nations equally existing in one system. Hong Kong is only a provincial entity, it is still subject to the national law. Whenever Hong Kong has any conflicts with the national level law, Hong Kong must be subject to the national law. The situataion actually is a little similar to the case in the United States of America, each state is independent in many ways including state level laws. But, if the matter involves federal business, FBI can arrest the person without agreement by any state, as state law authority must be subject to the federal law. There is no question about this. Hong Kong "一国两制" is about two systems in one nation, which only governs the matter between Hong Kong and other provinces. But, the national law is above the Hong Kong Law, if the matter involving the national interest. Well, I am not a legal scholar, but I can see this picture clearly with a simple logic. |
