很多人會說“有”，因為現行法律允許他們這麼做。是，這是事實，現行法律是這樣的。但合法的並不一定就是合理的。比如，過去法律規定，黑人不能與白人同校，黑人上公交車必須坐在最後面，黑人沒有選舉權。對嗎？不對。但卻是美國的法律，直到最後被廢除。還有我們都知道的排華法案，也是美國法律上百年後才被廢除。

同理，今天很多的法律也是不合理，沒有合法性。比如這個允許航空公司超賣機票，然後可以拒絕乘客上機的所謂法律。

我不知道這個法律是怎麼來的，但很容易推測是當年航空公司遊說國會的結果。過去，因為航空公司多，競爭激烈，乘客可以隨時取消機票卻沒有罰款。如果乘客取消機票離起飛時間太近，航空公司無法賣出被取消的機票，或被迫低價甚至超低價賣出，那麼航空公司就會蒙受損失。所以，國會網開一面，讓航空公司可以超賣有限的機票，將空座率降至最低。

但是近十幾年來，航空公司經過兼併，數量大減，競爭減少。現在如果要取消機票，甚至改簽都要付$200的費用。美國國內機票大多也只要200-300美元，考慮到這些退回的機票航空公司還可以再賣，所以航空公司幾乎不會因為旅客突然取消不飛而蒙受損失。加上過去乘客可以託運兩件行李，現在國內航班都只能託運一件，如果託運多，每件需要增加$50。

總之，航空公司盈利能力已經大大增加。比如一張$300的退票，航空公司從退票的乘客得到$200, 再賣出$100或更多，航空公司一點沒有虧。如果只是改簽，航空公司則淨賺$200。卻仍然要超賣就不合理了。這叫兩頭吃。正如一個人沒有工作，很貧困，以此申請了政府的困難補助。但後來有了工作，卻仍然一頭拿着不低的工資，一頭還要吃政府的補助，這就不合理了。

另外，航空公司可以超賣，那麼劇院，影院座位是不是也可以超賣？來人多了，再告知你不能進，或進了把人趕出來？是不是旅館也可以超賣房間，人來了告訴你，我們超賣了，你得等明天再來住？憑什麼航空公司就可以特殊？

總之，我們的政府在制定這個法律的時，考慮的是如何保護航空公司的盈利，而不是乘客的權益。我們應該看到，允許航空公司超賣的法律現在已經完全不合理，沒有任何法理基礎。正是這條惡法，才使得航空公司不顧乘客的權益，欺凌乘客而不受制裁。UA是第一次這麼幹嗎？絕對不是。只是過去沒有這麼多的手機，沒有這麼方便的Social Media，他們沒有被曝光，沒有受到懲罰。所以，他們這麼做只是習慣性動作，並非偶發事件。

請告訴你的國會議員，這條法律不合理，應該予以廢除。不然這樣的悲劇就會不斷上演。

Dear Watson Coleman,

I am very upset on the incident on UAL 3411, the UAL used reasonable force to drgged an senior passenger out of plane. It is horrible. 

The reason why UA was so careless on the right of the passengers is because the law allows them to do so as long as not go over. But what is the line? If it had been so popular of smart phones, and social media, we would have known what happened on UAL 3411 tow days ago.

The law (I don't know its code number) which allows Airlines to oversell the tickets is wrong right now. Because the Airlines right now charge high fee $200 for cancellation, and even change schedule, in comparison with average ticket about $200-300. The Airlines could resell these tickekts at a lower or same price dependent on the time of season. If the passengers didn't show, the arilines would not refund any money. This means that the Airlines have nothing to lose, which is different from the time when the law passed, the airlines allowed passengers to cancel without plenty.

With the law, Airlines have ignored the passenger's rights for years to make their profit maximum. How could we stop the incident happened? It is time to abolish the law for our passengers.

Please take action to protect our rights.
